Terms of Service

Welcome to Festrum. These Terms of Service (“Terms”) govern access to and use of the Festrum mobile app, the festrum.com website and related services (together, the “Service”). The Service is provided by ORBI TECHNOLOGY S.A.S., a Colombian company with tax ID (NIT) 902115398-2, based in Bogotá (“Festrum”, “we”). By creating an account or using Festrum, you accept these Terms in full. If you do not agree, do not use the Service.

1. Minimum age

You must be at least 18 years old to create an account and use Festrum. By signing up you confirm that you are an adult. If we find that an account belongs to someone under 18, we will delete it.

2. Description of the service

Festrum is a location-based social network for discovering nearby events, businesses, promotions and posts, and for interacting with other people through posts, comments, messages, reactions, stories and neighborhood groups.

3. User accounts

• You are responsible for keeping your login credentials confidential and for all activity on your account.
• You must provide truthful information when signing up. Fake, duplicate or impersonating accounts will be suspended.
• You can delete your account at any time from Settings in the app, or as explained at festrum.com/eliminar-cuenta.

4. User conduct and prohibited content

By using Festrum, you agree NOT to post, send or share content that:

• Is illegal, defamatory, fraudulent or misleading.
• Incites hatred, violence or discrimination based on race, gender, sexual orientation, religion, nationality or disability.
• Contains nudity, sexually explicit material or anything that sexualizes minors (zero tolerance).
• Harasses, intimidates or threatens other people.
• Promotes self-harm, suicide or eating disorders.
• Infringes third-party intellectual property rights.
• Is spam, unauthorized advertising or a fraudulent scheme.
• Promotes the sale of weapons, illegal drugs or other illegal activities.

Zero tolerance. Festrum does not tolerate objectionable content or abusive users. If you post or send content like the above, we remove it and may suspend your account immediately and permanently, without prior notice.

Breaking these rules may lead to content removal, warnings, temporary restrictions or permanent suspension, under our Community Guidelines.

5. User-generated content

You keep ownership of the content you post (photos, videos, text). By posting it on Festrum, you grant us a worldwide, non-exclusive, royalty-free license to store, display, reproduce and distribute that content within the Service, solely to operate and improve it. This license ends when you delete the content or your account, unless other users had already shared it.

Public events, posts and businesses can be viewed on festrum.com when someone shares their link. Private content and content from private accounts is never shown outside the app.

6. Events and meetups

Events are organized by users, not by Festrum. We do not verify or guarantee that they take place, their safety or their content. You attend at your own risk: check the organizer's profile, prefer public places and report any fake or dangerous event.

7. Businesses, promotions and plans

Users registered as businesses can create business profiles, publish promotions and access extra features depending on their plan (Free or Pro). Promotions have duration and quantity limits depending on the active plan. Festrum does not guarantee business results from using these features.

8. In-app purchases

Some features are paid inside the app with your Apple (App Store) or Google (Google Play) account:

• Subscriptions: Festrum Pro for businesses (monthly or yearly, with a 7-day free trial the first time) and Creator (monthly or yearly). They renew automatically at the end of each period, at the current price, unless you cancel at least 24 hours before. If you cancel during the free trial, you are not charged.
• How to cancel: in your App Store or Google Play account settings. Deleting the app or your Festrum account does not cancel the subscription.
• One-time purchases: extra event, event promotion and advertising campaigns for businesses. They are activated when the store confirms the payment.

Prices are shown in the app before you pay. Charges, invoicing and refunds are handled by Apple or Google under their own policies; refunds are requested from them. A promotion or campaign we remove for breaking these Terms is not refunded by Festrum. You can restore your purchases on a new phone with “Restore purchases” in Settings.

9. Location

Festrum uses your device's location, only while you use the app, to show you nearby content, events and businesses. You can turn off location access in your device settings, although some features may stop working.

10. Moderation and reports

We use automated systems and human review to detect content that breaks these Terms, including automatic analysis of images and text. Anyone can report content or accounts they find inappropriate with the “Report” option available on posts, comments, profiles, businesses, events, stories and chat messages. You can also block anyone: you will stop seeing their content and they will not be able to message you. We review reports within 24 hours and, when appropriate, remove the content and ban the person who posted it.

11. Sanctions

Depending on the severity of the violation, we may apply: (1) a warning, (2) a temporary restriction of features, or (3) permanent account suspension. Sanctioned users can appeal from the corresponding screen in the app.

12. Intellectual property

The Festrum brand, logo, design, source code and other elements of the Service belong to ORBI TECHNOLOGY S.A.S. and are protected by applicable intellectual property laws. If you believe content on Festrum infringes your copyright, let us know at our contact email.

13. Limitation of liability

Festrum is provided “as is” and “as available”. We do not guarantee that the Service will be error-free or uninterrupted. To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages arising from use of the Service, including losses from interactions between users, from user-organized events or from businesses listed on the platform.

14. Changes

We may update these Terms from time to time. We will notify you of significant changes in the app or by email. Continuing to use the Service after those changes means you accept the new Terms.

15. Governing law

These Terms are governed by the laws of the Republic of Colombia. Any dispute will be resolved before the competent courts of Colombia, without prejudice to mandatory rights granted by the user's local law.
